TAXI FOR EMAIL | LITMUS LIVE COMPETITION

 

1. WELCOME

1.1 This page sets out the terms and conditions that apply to the Litmus Live Competition (the "Competition").

1.2 The Competition is sponsored and administered by Future Design Unit Ltd (the "Promoter", "we", "us"). We operate an email content management, design and production service called "Taxi for Email" (the "Service").

1.3 This Competition is in no way sponsored, endorsed or administered by, or associated with Litmus Software, Inc or any of its associated companies or agents, or any other third party associated with the Litmus Live Conference.

1.4 By entering the Competition, you agree to these terms and conditions ("Competition Terms"). Please read these Competition Terms carefully and make sure you understand and agree to them before entering the Competition.

2. The Prize

2.1 The prize is a standard-entry ticket to the Litmus Live Conference in Boston (held 9-11 October 2019) (the "Boston Prize"), London (held 20 August 2019) (the "London Prize") or San Francisco (held 14-15 November 2019) (the "San Francisco Prize", and each of the Boston Prize, the London Prize and San Francisco Prize is a "Prize"). The ticket does not include access to event workshops.

2.2 There are 3 Prizes in total, 1 for each of the above cities. Winners of the Competition will receive a Prize for the city specified in their Entry.

2.3 The Prize is a ticket for entry to one of the above events only, and does not include travel or accommodation.

2.4 Prizes are subject to availability. There is no cash alternative for the Prize, and Prizes are not negotiable or transferable. The total approximate value of all the Prizes combined is $3,500.

3. Promotion Period

3.1 The Competition runs between:

(a) 18 June 2019 at 12:01 BST until at 11:59 pm BST on 29 June 2019 for the London Prize;

(b) 13 August 2019 at 12:01 BST until at 11:59 pm BST on 24 August 2019 for the Boston Prize;

(c) October 25 2019 at 12:01 BST until at 11:59 pm BST on 1 November 2019 for the San Francisco Prize;

 (and each of the above shall be a "Closing Date").

 

4. Who can enter?

4.1 The Competition is open to residents of the EU and US aged 18 years or over, except:

(a) employees of any of our group companies; or

(b) employees of any other organisation involved in the preparation or administration of the Competition; or

(c) anyone who is professionally connected with the Competition,

or the immediate family members of any of the above.

4.2 There is a limit of one entry per person. Entries on behalf of another person will not be accepted.

4.3 The Competition is void where prohibited by law.

5. How to Enter

5.1 In order to submit an entry to the Competition, you will need to describe why you would like to attend the event.

5.2 You do not need to sign up for a Taxi for Email account in order to enter the Competition. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

5.4 To enter the Competition, you must:

(a) Submit your Entry to us using the form at http://taxiforemail.com/hello/litmuslive before the relevant Closing Date for the Prize you have selected.

6. Winner Selection and Notification

6.1 Within 2 weeks of the end of the Closing Date for each Prize, we will choose one winning Entry for each city in which a Prize is offered. The odds of winning a Prize depend on the number of entries we receive. The Entries will be judged by an independent judge appointed by us, who will choose the winners based on the overall quality, creativity, originality and overall impression of the content of the Entry, and adherence to these Competition Terms and the Entry requirements.

6.2 Our decision is final and no correspondence or discussion will be entered into.

6.3 We will notify you by email if your Entry has won a Prize using the details you supplied to us when you set up your Account.

6.4 To claim your Prize, we may ask you to respond to our email notifying you that you have won. If we are unable to contact you, or if you do not claim your Prize within 7 days, we reserve the right to offer the Prize to the next eligible entrant selected by our judges.

7. Limitation of Liability

7.1 There are certain things for which we do not accept any liability to you. The law does not allow us to exclude or limit our liability for some things, such as death or personal injury caused by our negligence, or loss caused by a false statement where the statement is made fraudulently. We accept full liability for these matters and all matters for which we cannot, under English law, exclude or limit our liability. Otherwise, the exclusions of liability below will apply. References to "us" or the Promoter in these paragraphs include all of our associated companies, agents or any other third party involved in the Competition.

7.2 We will also not be responsible for (and will have no liability in connection with) any occurrences beyond our control, including but not limited to:

(a) any postponement or cancellation of the Competition;

(b) any cancellations or changes to Prizes or the way in which they can be used;

(c) problems with the dispatch of Prizes (such as Prizes failing to reach the intended recipient);

(d) any act or default of any third party supplier;

(e) any alteration, unauthorised access, damage, late-delivery or non-delivery of any Entry, notice, acceptance, request or other document related to the Competition; and  

(f) the winner not taking advantage of a Prize due to health or any other reason.

8. Your Content and your Personal Details

8.1 We may use the materials and information you submit to us in connection with administering and promoting the Competition. By submitting your Entry and any other materials related to the Competition (your "Competition Materials"), you grant us a worldwide, non-exclusive, royalty-free licence to use, copy, reproduce and make available your Competition Materials anywhere and in any form for the purposes of administering and promoting the Competition.

8.2 We may use your personal data, such as your name, town or country of residence and your email address, to administer and promote the Competition and to contact you in relation to your Entry. If you win a Prize, we may share this information with third parties, such as the organisers, agents or partners of the Litmus Live Conference, and to announce the winners of the Competition.

8.3 We may also use your name and likeness for advertising and publicity purposes without additional remuneration. The winners of the Competition may be asked to take part in reasonable publicity and PR activity at our request.

9. General

9.1 If any provision of these Competition Terms is judged to be illegal or unenforceable, this will not affect the continuation in full force and effect of the remainder of the provisions.

9.2 English law will apply to all disputes and the interpretation of these Competition Terms. The English courts will have non-exclusive jurisdiction over any dispute arising from or related to this Competition (including the Prizes).
